1. Area of application
The following terms and conditions apply to the use of the site and the services provided therein of the Cologne Conference GmbH, Machabäerstraße 5, 50668 Cologne, GERMANY as well as any contractual relationship with users or costumers resulting from it.
By using the website and the services provided therein the user or customer explicitly acknowledges the these terms and conditions. Therefor these must not be explicitly stipulated again before the use of each single service or execution of each bussiness transaction.
2. Tickets
The Cologne Conference GmbH sells single tickets for screenings at the Film Festival Cologne via our partner Ticket.io. The sale is conducted at an online shop as well as at the box offices at the festival’s cinemas. By correctly inputting the data necessary for payment procedure and clicking the “Purchase Now” button, a binding offer to buy is given. The offer is accepted through confirmation of reservation. Please be advised that rules regarding the right of rescission do not apply to distance contracts (see § 312g paragraph 2 Nr. 9 BGB). After the online purchase is completed, replacement, restitution and rescission of tickets is no longer possible. The ticket prices as indicated online all include VAT. In case of obvious price errors we reserve our right to cancel the contract.
The ticket is the only means of authorisation to enter the venue. The ticket is only valid for the selected screening. If after five minutes before the screening has started you have not entered the venue the ticket is void. There is no right to restitution. A rescission of the tickets is only possible in case of a cancellation or postponement of the film screening. The change of language version and/or of subtitles or dubbing is no reason for reclamation.
3. Festival passes
The Cologne Conference GmbH sells two categories of festival passes for the Film Festival Cologne via our partner Ticket.io. Therein included are single tickets for festival screenings as well as other services as specified separately. These passes are available while stocks last and can be purchased via the online shop as well as at the box offices and the festival’s cinemas. By correctly inputting the data necessary for payment procedure and clicking the “Purchase Now” button, a binding offer to buy is given. The offer is accepted through confirmation of reservation. Please be advised that rules regarding the right of rescission do not apply to distance contracts (see § 312g paragraph 2 Nr. 9 BGB). The passes are only valid for the current Film Festival Cologne. Unused single tickets are void, there is no claim for cash reimbursement or credit voucher. There is no right to a ticket if the screening is sold out.
4. Accreditations
Accreditations grants entry to all screenings and industry program of the current Film Festival Cologne, if not declared otherwise. Accreditations are only available while stocks last. The Cologne Conference GmbH sells festival accreditations for the Film Festival Cologne to members of the press, business insiders and students via our partner Ticket.io. After the accreditation proposal has been reviewed and granted, the accreditations can be purchased via the online shop as well as at the box offices and the festival’s cinemas. By correctly inputting the data necessary for payment procedure and clicking the “Purchase Now” button, a binding offer to buy is given. The offer is accepted through confirmation of reservation. Please be advised that rules regarding the right of rescission do not apply to distance contracts (see § 312g paragraph 2 Nr. 9 BGB). 5. Return of debit advise and credit card transactions
After the sales contract is concluded (confirmation of reservation) the order’s overall price including all fees is payable immediately. Pending complete payment, the tickets, festival passes ans accreditations remain our property.
If we are unable to charge the agreed amount from your account or credit card, e.g. because the account is not sufficiently funded or the account data or credit card data are wrong, we have the right to apply debt collection. We are then permitted to relay your name, address, account information and data necessary for debt collection both to debt collection companies or third parties authorized for debt collection. We also retain the option to abdicate from the contract and make damage claims.
6. Privacy and security
With his order the customer agrees to have the data necessary for processing the transaction is stored an relayed only to companies which are connected to the processing of the transaction and support the Cologne Conference GmbH in this endeavor. This stored data includes address information and sometimes other data necessary for certain payment methods as well as the connection between the order data (article, amount, etc.) and the address information. The customer always retains his right to inquire about the data stored at the Cologne Conference GmbH at any time. All personal data are handled confidentially. No data will be relayed to third parties that are not part of the processing procedure of the order. The Cologne Conference GmbH will apply greatest care and highest security standards to protect personal information from unauthorized access. For internet transaction, the customer’s data will be protected by technical security systems.
7. Exemption from thrid party claims of compensation
Since you as the the website’s user are responsible for your own contributions, actions and data input, you are obligated to exempt us from any third party claim resulting in your use of the website ad the services provided therein, especially if these claims originate from your unlawful use of the website or system or the breach of third party property rights (e.g. copyright). You are also liable to pay for compensation for the cost and damages payable because of such claims.
8. Liability
The Cologne Conference GmbH is in no way accountable for damages if these damages are not the result of deliberate neglect of duty or grossly negligent behavior of one of Cologne Conference GmbH’s legal agents or auxiliary persons. The Cologne Conference GmbH is also not accountable for any damages as stated in the law on product liability. In case of careless neglect of a principal obligation the amount of damage payment does not exceed the tickets’ price of purchase plus such damages as are necessary for the tickets’ acquisition elsewhere. Acts of nature beyond control and other service disruptions not represented by the Cologne Conference GmbH free the Cologne Conference GmbH from all liability.
In case of blackout, interruption or disruption of your technical systems or your internet provider we do not assume liability. The same applies in case of damages resulting from your software or hardware working deficiently or being infected by malware. We do not assume liability in case of loss or not complete or belated or otherwise incorrect transfer of data, in case of blackout, interruption or disruption of the phone line, the internet, our server or any of the net providers’ other communication systems. This does not apply to cases of neglect of principal obligations and services. The same applies for blackout, interruption or disruption of our technical facilities.
We do not assume liability for our computers and websites to run efficiently and uninterrupted at all times, that they’re available and accessible at all times or that there is a steady and secure data transfer, that the information provided by our website are correct, complete and up-to-date at all times-
We do not assume liability for damages resulting from you giving wrong information to us. In case of damages caused by unauthorized third party access to your data stored by us we only assume liability in case of deliberate neglect or gross negligence. We do not assume liability for damages resulting from input errors on your side.Our liability is confined to direct damages. Immediate damages like loss of data or other secondary damages are excluded from our liability.
9. Relevant law, place of jurisdiction and place of fulfillment
German law applies. The United Nations accord about international sales contracts (CISG) do not apply. Rules of international consistent sales law are, as far as allowed, waived. Place of fulfillment is Cologne. For commercial customers, the agreed upon place of jurisdiction is Cologne in the Federal Republic of Germany (Art.23 EuG VVO).
10. Changes
We reserve our right to investigate, update and changes these terms and conditions, especially as law and jurisdiction make this necessary. We will alert you to any changes on this site. The changes are valid from the moment of publication. By using the website and the services provided therein the user or customer explicitly acknowledges the these terms and conditions in their current form.
11. Severability
In case one or several of the clauses in these terms and conditions are invalid, incomplete or require elaboration, the validity of the other clauses are not affected. In their place or to close the contractual gap there shall be clauses that come closest to the commercial interests of both parties.
